FlareNetwork uses a structured, multi-step process to handle copyright claims. Both the rights holder and the content creator have defined windows to respond, and claims are resolved based on the actions (or inaction) of each party.
Step 1: Claim Filed
A rights holder submits a DMCA claim through the claim form. The claim includes a link to the original work, a description of the infringement, a fair use rebuttal, and a sworn declaration under penalty of perjury. The claim enters pending_creator status.
Step 2: Creator Response (7 Days)
The content creator is notified via their Message Center and has 7 days to respond. During this window, the creator can:
- Accept the claim — the claim enters a rectification period where the creator can modify or remove the content
- Dispute the claim — file a counter-notice explaining why the claim is invalid
- Communicate — send messages to the rights holder to discuss the issue
If the creator does not respond within 7 days, the rights holder wins by default and the claim is resolved as resolved_holder_won.
Step 3: Rights Holder Response (7 Days)
If the creator files a counter-notice, the claim moves to pending_holder status. The rights holder then has 7 days to respond. They can:
- Satisfy — accept the counter-notice and withdraw the claim
- Withdraw — voluntarily drop the claim
- Escalate — request FlareNetwork review the dispute
If the rights holder does not respond within 7 days, the creator wins by default and the claim is resolved as resolved_creator_won.
Step 4: Rectification Period (7 Days)
When a creator accepts a claim, the claim enters rectification status. The creator has 7 days to modify or remove the infringing content. If the creator completes the rectification, the claim resolves as resolved_rectified. If they fail to act, the claim resolves in favor of the rights holder.
Step 5: Escalation
If either party escalates the claim, it enters escalated status and is reviewed by FlareNetwork's team. The team examines the evidence from both sides and makes a final determination. Escalated claims may result in content removal, claim dismissal, or other appropriate action.
